Amendments were made to the Communiqués on Import Control of Radio Equipment and Certain Products that must bear the “CE” Mark

Pursuant to the Communiqués entered into force with the Official Gazette dated 6 January 2024 and numbered 32421; changes have been made in the import inspection of radio equipment and some products that must bear the “CE” marking.

In the Official Gazette dated 6 January 2024 and numbered 32421; Communiqué Amending the Communiqué on Import Control of Certain Products Required to Bear “CE” Marking and Communiqué Amending the Communiqué on Import Control of Radio Equipment were published.

The amended Communiqué on Import Control of Certain Products Required to Bear “CE” Marking was published in the Official Gazette dated 31 December 2023 and numbered 32416. The “CE” marking is the Union marking for Conformité Européenne, which indicates that the products have passed all necessary conformity assessment activities and comply with the requirements of health, safety and consumer and environmental protection in order to ensure the free movement of goods within the framework of the harmonisation of technical legislation of the European Union.

In this Communiqué, the procedures and principles regarding the inspection of the compliance of some products that must bear this mark with the legislation to which they are subject to import are regulated. The list of goods subject to the procedures and principles regulated in the Communiqué is listed in Annex-2 of the Communiqué. With the Amendment dated 6 January 2024, the phrases “for electric vehicles” in lines 421, 424 and 430 of Annex-2 have been changed as “charging stations for electric vehicles”, the HS codes in lines 442 and 443 in Annex-2 have been changed, and line numbered 428 “HS Code: 8504.40.90.90.90.19 – Article Name: Others – Related Regulation: LVD, EMC” has been removed from the scope of the Communiqué.

The Communiqué on Import Control of Radio Equipment which was published in the Official Gazette dated 31 December 2023 and numbered 32418 amended by the Communiqué published in the Official Gazette dated 6 January 2024 and numbered 32421. With this Communiqué, the procedures and principles regarding the inspection of the compliance of the products listed in Annex-1 of the Communiqué with the Radio Equipment Regulation are regulated. With the Communiqué published in the Official Gazette dated 6 January 2024, a line with the HS code number 8517.13.00.00.19 and the item name “Others” was added under the line “Smart watches” in this Annex-1. While Article 3 of Annex-2 of the same Communiqué regulated as “EU Declaration of Conformity (Annex-3) – In cases where it is issued in other languages, together with a certified copy of the Turkish translation (*)”, the phrase “(Annex-3)” in this article has been abolished.
