The Regulation Amending the Regulation on Principles and Rules to be Applied in Retail Trade (“Amending Regulation“) was published in the Official Gazette dated 14.12.2023 and numbered 32399.

Accordingly, the Amending Regulation defines the concept of “agricultural and food products that may deteriorate within thirty days”, and then regulates which situations constitute unfair commercial practices by regulating that unfair commercial practices cannot be made in the supply chain. Especially in the supply chain; forcing the supply of goods or services from any real or legal person, reflecting the cost of the campaign to the party that does not want to make campaign sales, not determining the terms of the commercial relationship in the supply of agricultural and food products by written contract or by e-mail, fax or other written means in electronic media that can show the agreement between the parties, authorising unilateral changes to the detriment of the other party or including provisions in the contract that are not clear and understandable in essential matters such as maturity, return and campaign conditions are determined as unfair commercial practices.

The Amending Regulation also introduces regulations on the duration of payments arising from commercial relations between producers, suppliers and retail businesses.
