The following article gives a summary of decrees by the Council of Ministers and communiqués by the Ministry of Commerce regarding prevention of unfair competition in imports, made between 1 September 2018 and 31 September 2018

Safeguard Measures Continue to Apply to Firebrick Imports from China

Following an investigation by the General Directorate of Import of the Ministry of Economy, it has been determined that dumping and damage would probably re-occur if the current measures were removed. Therefore, the following safeguard measures will continue to apply:

Tariff Quotas Introduced for Imports of Acetylacetone and Sodium Lugno Sulfonate

A Presidential Decree imposed tariff quotas on the following goods. For imports within the scope of the tariff quotas, the following customs taxes will apply.

The tariff quotas were outlined in Presidential Decree number 60, published in Official Gazette number 30526 on 5 September 2018, entering into effect on the same day.

Investigation Announced for Imports of Textiles Woven from Synthetic Filament Yarns

The General Directorate of Import of the Ministry of Economy has opened an investigation into actions against current measures regarding imports of textiles woven from synthetic or artificial discontinuous fibres defined under tariff codes of 55. 13, 55. 14 and 55. 16.

The investigation was announced in the Communiqué on Safeguard Measures in Imports number 2018/33, published in Official Gazette number 30528 on 7 September 2018, entering into effect on the same day.

Safeguard Measures Amended for Imports of Synthetic Filament Textiles from China

The Undersecretariat of Foreign Trade had extended the tax rate of 70.44% of the CIF cost for imports of synthetic filament textiles under tariff code 54.07 from China. Accordingly, the tax rate will now also apply to goods from the Philippines and/or originating from the Philippines.

The General Directorate of Import of the Ministry of Economy now amends the measures applied for goods from the Philippines and/or originating from the Philippines, as of 8 September 2018:

Safeguard Measures to Continue for Imports of Texturized Yarns from Polyesters from India and Taiwan

Following an investigation by General Directorate of Import of the Ministry of Economy, it has decided to continue the anti-dumping measures, as set forth in the table below:

Investigation Announced for Imports of Electric Storage Water Heaters from China, Italy and Serbia

The General Directorate of Import of the Ministry of Economy has decided to open a final revision investigation regarding current measures against dumping of “Others (Electric Storage Type Water Heater)” originating from China, Italy and Serbia under tariff code 8516.10.80.00.19.

The financial obligations are outlined in the Communiqué on Safeguard Measures in Imports number 2018/32, published in Official Gazette number 30529 on 8 September 2018, entering into effect on the same day.

Procedures and Principles Introduced for Tariff Quotas on Toothbrush Imports

The Ministry of Economy has regulated the procedures and principles for application, distribution and usage of tariff quotas granted for toothbrush imports under tariff code 9603.21.00.00.00. The tariff quotas will be distributed based on a first-come first-served basis.

The Tariff Quotas were outlined in the Communiqué on the Management of Contingents and Tariff Quotas in Imports number 2018/4, published in Official Gazette number 30530 on 9 September 2018, entering into effect on the same day.

Procedures and Principles Introduced for Tariff Quotas on Wallpaper and Similar Wall Coverings Imports

The Ministry of Economy has regulated the procedures and principles for application, distribution and usage of tariff quotas granted for wallpaper and similar wall coverings imports under tariff code of 4814.20.00.00.00, 4814.90.10.00.00 and 4814.90.70.10.00. The tariff quotas will be distributed by collecting the demands.

The Tariff Quotas were outlined in the Communiqué on the Management of Contingents and Tariff Quotas in Imports number 2018/5, published in Official Gazette number 30530 on 9 September 2018, entering into effect on the same day.

Inspection Certificate will be required for Clutch Pedal, Accessory and Part Imports

According to Communiqué on the Implementation of Inspection on Imports number 2018/8 which was published in Official Gazette number 30537 on 16 September 2018, an inspection procedure will now apply for:

The specified goods may be imported with an Inspection Certificate issued by the General Directorate of Import of the Ministry of Economy. The abovementioned inspection certificates are valid for six months.

Temporary Safeguard Measures Imposed on Iron and Steel Good Imports

A temporary safeguard measure for 200 days has been imposed on iron and steel goods, which are subject to investigation by the General Directorate of Import of the Ministry of Economy pursuant to the Communiqué on Safeguard Measures in Imports (Communiqué number 2018/3). Accordingly, 25% of additional financial obligations will apply on these goods and a tariff quota will apply for exemption from the additional financial obligations.

The financial obligations were outlined in the Communiqué on Safeguard Measures in Imports number 2018/7, published in Official Gazette number 30541 on 20 September 2018, entering into effect on the same day.

Investigation Announced into Continuation of Safeguard Measures on Glass and Float Glass Imports from Iran 

The General Directorate of Import of the Ministry of Economy has decided to open an investigation regarding the continuation of current safeguard measures for the imports of drawn and blow glass under Tariff Code70.04 and float glass and polished or glossed glass under Tariff Code70.05 from the Islamic Republic of Iran.

The investigation was announced by the Communiqué on Safeguard Measures in Imports number 2018/5, published in Official Gazette number 30549 on 28 September 2018, entering into effect on the same day.
